Alice continued to pay the premiums to Progressive on the homeowner’s policy, and Progressive continued to renew the insurance and collect the premiums paid by Alice.When a fire destroyed the house, Progressive denied coverage to Alice claiming that the policy was still in Phil’s name and they did not have a contract with Alice. Alice filed a lawsuit against the insurer. Progressive was held liable to Alice under the homeowner’s policy.
